The paper offers a modelling of the sense of justice as it is displayed in ordinary situated disputes. While this model accounts for a plurality of legitimate forms of evaluation which are used in the process of critique and justification, it escapes a relativism of values by demonstrating that all these forms satisfy a set of common requirements. The reasonable character of the everyday sense of justice is also anchored in a reality test involving the engagement of objects which qualify (...) for a certain form of evaluation. The paper discusses this model in relation to competing theories of justice, and models of social action and interaction. (shrink)

Beginning my third year with the Kansas City Chiefs and being also a medical student at McGill University, I was at first a little reluctant to comment on Glenn Cohen et al.’s critique of the National Football League's structure involving player health and team doctors, but the opportunity to provide a perspective as both a football player and a medical student was too much to forgo. Because of my athletic and academic background, I am often asked what I think about (...) injuries in professional sports and about the role of sports medicine physicians, and Cohen et al.’s article demands a thoughtful reaction. I want to suggest that the fundamental principles concerning the medical profession and the doctor-patient relationship provide additional arguments for some of the solutions that Cohen et al. discuss. The professional self-regulation that the proposed medical committee could provide and the reliance on a doctor who was not hired by the player's employer—the club—for a second opinion are both good ways to minimize conflicts of interest. Pierre Bourdieu a longuement analysé ce qu'il qualifiait de "champ politique". Mais pour penser la politique politiquement, il convient de la penser "hors-champ". Politique hors-champ se présente comme une contribution à la critique de la politique considérée comme un champ particulier et séparé de la vie sociale. Limiter la politique à ses moments institutionnels, alors qu'elle est tout à la fois une pratique sociale, est un appauvrissement de ses potentialités, incompatible avec toute politique d'émancipation - c'est à dire de politique (...) communiste. Il en résulte une critique de certains des concepts les plus habituels de la théorie politique, comme la "société civile", qui suppose une "société politique" distincte et refermée sur elle-même, comme les "partis", qui tendent à s'approprier l'action politique au détriment de la masse des citoyens, et même comme la "démocratie", considérée comme un type d'institutions distinctes de la société elle-même et dès lors insensibles à ses contradictions. Un long chapitre propose de suivre le parcours de l'idée de la politique dans le travail d'un certain nombre d'auteurs classiques, de Machiavel à Marx, montrant comment s'enracinent les thèses proposées dans l'analyse de certaines intuitions, certains développements, voire certaines impasses de ces auteurs. S'ensuivent des critiques détaillées des conceptions classiques de la démocratie et de la notion de parti politique. Pour illustrer les thèses soutenues dans l'ouvrage, différentes époques de l'histoire et différentes disciplines du savoir sont mobilisées, de l'Antiquité classique à la Révolution française ou la Révolution russe, et de l'anthropologie à la sociologie ou la philosophie. L'ensemble constitue un tout à la fois cohérent et ouvert au terme duquel la politique, dont l'enjeu est l'hégémonie, apparaît comme le véritable levain de l'histoire. (shrink)

This paper investigates the idea of reasoning, in a local (or contextual) way, under prioritized and possibly inconsistent knowledge bases. Priorities are not supposed to be given globally between all the beliefs in the knowledge base, but locally inside sets of pieces of information responsible for inconsistencies. This local stratification offers more flexibility for representing priorities between beliefs. Given this local ordering, we discuss five basic definitions of influence relations between conflicts. These elementary notions of influence between two conflicts A (...) and B exhaustively explore the situations where solving A leads to solve B. Then we propose natural approaches to restore the coherence of a knowledge base on the basis of influence relations between locally-stratified conflicts. (shrink)

This article is a review of Franz Brenatno’s material ontology. We support the thesis that Brentano defends an original type of monism. This monism can be seen as the conjunction of three theories: reism (the thesis that there are only concrete individual things), priority monism (the thesis that there is only one substance), and supersubstantivalism (the thesis that this substance is space).

In the model proposed by Findlay & Walker, the programming of saccadic eye movements is achieved by two parallel processes, one dedicated to the coding of saccade metrics (Where) and the other controlling saccade initiation (When). One outcome of the “winner-take-all” characteristics of the salience map, the main node of the model, is an independence between the metrics and the latency of saccades. We report on some observations, made in the head-unrestrained cat under pathological conditions, of a correlation between accuracy (...) and latency of saccadic gaze shifts. To account for such a correlation, the link between metrics specification (Where) and saccade triggering (When) should be amended in the model. (shrink)

Student cheating has always been a problem in higher education, but detection of cheating has become easier with technology. As a result, more students are being caught and reported for cheating. While reporting cheating is not a negative, the rippling effects of reported cheating may be felt by some populations more than others. Thus, preventing cheating would be a preferable option for all involved.Identifying those at risk for being reported for cheating is a first step in developing preventive measures. Previous (...) research has attempted to do this through the use of self-report surveys, but such research takes considerable time and resources to conduct and suffers from low response rates and social desirability bias. To address this limitation in existing research, this study links existing data from records of other-reported cheating to university registration data in order to examine 6 cheating risk factors identified in previous research: maturity level, gender, grade point average, major, international student status, and fear of punishment. The results of the study suggest that international and transfer students, particularly those who are male, in high-risk majors, and have lower grade point averages, are in particular need of preventative education. Likewise, those faculty who teach in computer science, engineering and economics majors should do more to educate implement practices to reduce the likelihood of cheating. (shrink)

Cheating in the undergraduate classroom is not a new problem, and it is recognized as one that is endemic to the education system. This paper examines the highly normative behavior of using unauthorized assistance (e.g., a solutions manual or a friend) on an individual assignment within the context of an upper division undergraduate course in engineering mechanics. The findings indicate that there are varying levels of accepting responsibility among the students (from denial to tempered to full) and that acceptance of (...) responsibility can lead to identification of learning and necessary behavioral changes. The findings have implications for institutions and engineering faculty, in particular the need for consistent academic integrity education and the teaching of professional integrity and ethics. R. A. Duff has revived the tradition of “answerability” for crime. In this philosophical and jurisprudential tradition, a person is answerable to the criminal law of a state and the process of that state’s courts only if there is some appropriate relationship between the state and the person. Duff’s great contribution has been to develop the idea of accountability of persons to a state or other polity as a philosophical notion which, he argues, underlies all just implementations of criminal law. (...) Duff has centered his views around the relationship between the citizen and the polity (in today’s world, the state) to which the citizen belongs. His focus has been on insiders, rather than outsiders.This article argues that, in the current world, the relationship among cocitizens, outsiders, and the state is based in part on the moral idea that the state exists to protect citizens from evil acts, specifically those that we call public and criminal wrongs, wherever the acts originate. Outsiders understand this, and understand that states other than their own use criminal law to protect their citizens.Duff’s writings contain an idea which turns out to be very useful in cases of outside acts, even though he does not apply it directly to them. Some states or other entities may have only an incomplete relationship with an accused person (compared with the relationship of citizen and state), but nonetheless may have the moral and political authority to try her for crime. This paper extends this notion to show that such incomplete relationships exist in a great many common cases of outsiders (noncitizens who act outside the territory of a state) who commit crime. These relationships support criminal prosecution of outsiders, so long as we admit that protection of persons from crime is a legitimate goal of the criminal law. (shrink)

Purpose – This paper aims to respond to Curno’s piece on the Challenges to ethical publishing in the digital era. Design/methodology/approach – In this response, the author argues that a focus on “publication ethics” may perpetuate the problem of unethical conduct because such a focus ignores the influences of the educational ethics pipeline. Findings – As a result, the author issues two calls for action: we must cease operating in our ethical silos and educational leaders must publicly recognize the problem (...) of unethical conduct and fully commit to addressing it. Originality/value – This response challenges the notions of ethical silos and the inaction by educational institutions to properly train ethical professionals, authors and researchers. (shrink)

This is the first volume of a two-volume project whose aim is to publish all the known Middle English manuscript translations of the French Somme le mi, a thirteenth-century manual of religious instruction offering teaching on the Decalogue, the seven deadly sins and their remedies, compiled by the Dominican friar Laurent of Orleans. The project extends and deepens our knowledge of the influence of this popular French text, known today only from the versions entitled The Ayen bite of Inwit (...) and The Book of Vices and Virtues, published in 1866 and 1942, respectively. This volume presents the versions extant in BL MSS Royal 18. A. x and Add. 37677; the second will cover the versions in Cambridge, Corpus Christi College, MS 494, Oxford, Bodleian Library, MS Ashmole 1286, and Oxford, Bodleian Library, MS e Musaeo 23. The texts of both volumes have been prepared with the help of the recently-published edition of the French text, a circumstance from which the earlier English editions were unable to benefit. It is likely that the versions edited here for the first time will make a considerable contribution to our understanding of the processes of textual transmission and to that of translation itself in English literary circles of the fifteenth century. This article argues that many situations in social life can be analyzed by their requirement for the justification of action. It is in particular in situations of dispute that a need arises to explicate the grounds on which responsibility for errors is distributed and on which new agreement can be reached. Since a plurality of mutually incompatible modes of justification exists, disputes can be understood as disagreements either about whether the accepted rule of justification has not been violated or about (...) which mode of justification to apply at all. The article develops a grammar of such modes of justification, called orders of worth (grandeur), and argues that the human capacity for criticism becomes visible in the daily occurrence of disputes over criteria for justification. At the same time, it is underlined that not all social situations can be interpreted with the help of such a sense of justice, which resides on a notion of equivalence. Regimes of love, of violence or of familiarity are systematically distinct from regimes of justification. (shrink)

Research on academic cheating by high school students and undergraduates suggests that many students will do whatever it takes, including violating ethical classroom standards, to not be left behind or to race to the top. This behavior may be exacerbated among pre-med and pre-health professional school students enrolled in laboratory classes because of the typical disconnect between these students, their instructors and the perceived legitimacy of the laboratory work. There is little research, however, that has investigated the relationship between high (...) aspirations and academic conduct. This study fills this research gap by investigating the beliefs, perceptions and self-reported academic conduct of highly aspirational students and their peers in mandatory physics labs. The findings suggest that physics laboratory classes may face particular challenges with highly aspirational students and cheating, but the paper offers practical solutions for addressing them. This essay attempts to describe the neo-Lamarckian atmosphere that was dominant in French biology for more than a century. Firstly, we demonstrate that there were not one but at least two French neo-Lamarckian traditions. This implies, therefore, that it is possible to propose a clear definition of a (neo) Lamarckian conception, and by using it, to distinguish these two traditions. We will see that these two conceptions were not dominant at the same time. The first French neo-Lamarckism (1879-1931) was structured (...) by a very mechanic view of natural processes. The main representatives of this first period were scientists such as Alfred Giard (1846-1908), Gaston Bonnier (1853-1922) and Félix Le Dantec (1869-1917). The second Lamarckism - much more vitalist in its inspiration - started to develop under the supervision of people such as Albert Vandel (1894-1980) and Pierre-Paul Grassé (1895-1985). Secondly, this essay suggests that the philosophical inclinations of these neo-Lamarckisms reactivated a very ancient and strong dichotomy of French thought. One part of this dichotomy is a material, physicalist tradition, which started with René Descartes but developed extensively during the 18th and 19th centuries. The other is a spiritual and vitalist reaction to the first one, which also had a very long history, though it is most closely associated with the work of Henri Bergson. Through Claude Bernard, the first neo-Lamarckians tried to construct a mechanical and determinist form of evolutionary theory which was, in effect, a Cartesian theory. The second wave of neo-Lamarckians wanted to reconsider the autonomy and reactivity of life forms, in contrast to purely physical systems. (shrink)

Cognitive forms vary considerably as a human being detaches herself from what is closest and most personal and moves to communicate — in the broad sense of taking part in a common matter — across increasing relational distances. The article proposes to deal with the variety of cognitive formats which cannot `commonize' cognition to an equal degree, relating them to a set of regimes of engagement with the world that are identified in terms of the dependency between the human agent (...) and her environment. The good that engagement aims to guarantee orients how reality is grasped and specifies the format of what constitutes relevant information. This analysis offers new insight into the composition of communities as well as persons who have to cope with the plurality of cognitive formats and engagements from the very familiar to the most public. Since the 1990s, the terms “Lamarckism” and “Lamarckian” have seen a significant resurgence in biological publications. The discovery of new molecular mechanisms have been interpreted as evidence supporting the reality and efficiency of the inheritance of acquired characters, and thus the revival of Lamarckism. The present paper aims at giving a critical evaluation of such interpretations. I argue that two types of arguments allow to draw a clear distinction between the genuine Lamarckian concept of inheritance of acquired characters and transgenerational (...) epigenetic inheritance. The first concerns the explanandum of the processes under consideration: molecular mechanisms of transgenerational epigenetic inheritance are understood as evolved products of natural selection. This means that the kind of inheritance of acquired characters they might be responsible for is an obligatory emergent feature of evolution, whereas traditional Lamarckisms conceived the inheritance of acquired characters as a property inherent in living matter itself. The second argument concerns the explanans of the inheritance of acquired characters: in light of current knowledge, epigenetic mechanisms are not able to drive adaptive evolution by themselves. Emergent Lamarckian phenomena would be possible if and only if individual epigenetic variation allowed the inheritance of acquired characters to be a factor of unlimited change. This implies specific requirements for epigenetic variation, which I explicitly define and expand upon. I then show that given current knowledge, these requirements are not empirically grounded.
